The chief justice’s court is scheduled to hear the plea of former Union minister Jairam Ramesh vide Jairam Ramesh v Union of India and Ors. (W.P.(C) No.-558-/2017 PIL-W) and decide on a stay application. The matter was ordered to be clubbed together with the other pleas on stay application and referred to a constitution bench by a bench comprising of Deepak Mishra CJ. , A.M. Khanwilkar and D.Y. Chandrachud JJ on 17th January 2018.
The plea has taken a turn of constitutional importance and the counsels for the petitioner including Kapil Sibal and P Chidambaram have maintained that the court can intervene in the decision of the Speaker of the Lok Sabha if she has broken house rules.
The plea states that the amendments to Aadhar on which concerns were raised by some members of the Rajya Sabha was introduced as a Money bill through Lok Sabha.
The apex court is set to examine whether the decisions of the speaker would fall under judicial scrutiny or not.
